By accessing or using the PermitStack website (permitstack.io) or the PermitStack application (the “Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the website or Service. PermitStack is operated by 25 Fathoms LLC dba PermitStack (“we,” “us,” “our”), a New Mexico limited liability company.
PermitStack is a subscription compliance operating system for multi-site waste operators. The Service tracks permits, renewals, inspections, monitoring requirements, sample results, incidents, training, financial assurance, and related compliance data across a customer’s permitted facilities. The Service is offered in three subscription tiers (Starter, Operator, Regional), with optional add-on modules (Landfill Module, SharePoint Sync), and a 90-day Pilot. Current features and limits are described at permitstack.io/pricing.
Every subscription tier includes the core compliance backbone: permit register, renewals, inspections, monitoring, incidents and corrective actions, training and certifications, financial assurance, audit log, and role-based permissions. Tier differences are scale (sites, users, states covered) and depth-of-feature gates (manual entry versus API ingest, support response, audit log retention). Add-on modules are available at any tier and billed separately. The 90-day Pilot is a one-time fixed-fee engagement on a single site; the Pilot fee credits to your setup fee if you convert to a paid tier within 60 days of pilot end.
Subject to your timely payment of fees and your compliance with these terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for the duration of your subscription, within the limits of your tier (sites, users, states). You may not redistribute, resell, sublicense, reverse engineer, decompile, or copy any portion of the Service or its underlying code. The same license applies during the 90-day Pilot term.
You are responsible for the accuracy of the data you upload, the credentials you assign to your users, and the activity of those users. You agree to notify us promptly of any suspected unauthorized access. You will keep your billing and notification contact information current so compliance alerts and service notices reach you.
You agree not to use the Service to violate any applicable law or regulation; transmit malicious code; interfere with the operation of the Service or another customer’s use of it; misrepresent your identity, your facility, or your regulatory status; submit fabricated compliance data; or use the Service for any facility you are not authorized to manage.
The Service depends on third-party platforms. Current subprocessors include Airtable (data layer), Noloco (customer portal), n8n Cloud (workflow automation), AWS S3 (document storage), and Mailgun (transactional email). Customers who purchase the SharePoint Sync add-on authorize PermitStack to access their Microsoft 365 tenant through Microsoft Graph for the document libraries they specify. Your use of any subprocessor’s interface is also subject to that subprocessor’s terms. We will give you 30 days advance notice before adding or replacing a subprocessor that processes customer data.
You own all customer data you upload to or generate within your tenant base. We process that data only to provide and improve the Service for you. We do not sell customer data, and we do not use customer data to train external machine-learning models. On termination, we will export your data on request in a portable format (CSV or equivalent) within 30 days and delete it from active systems within 90 days; backup copies age out per the underlying subprocessor’s retention policy.
Subscriptions are billed in advance, monthly or annually. Annual subscriptions auto-renew for successive annual terms unless cancelled at least 30 days before the renewal date. Prices may change at renewal with at least 30 days notice. Setup fees are non-refundable once setup work has begun. The 90-day Pilot fee is non-refundable but credits to setup on timely conversion. Subscription fees paid in advance are non-refundable except where required by law.
PermitStack, including the name, marks, software, documentation, and any regulatory content libraries authored by PermitStack, is the intellectual property of 25 Fathoms LLC. The PermitStack name, the PermitStack mark, and the tagline “Every permit. Every site. One screen.” are trademarks of 25 Fathoms LLC. Nothing in these terms grants you any right to use our marks without prior written consent.
Each party will protect the other party’s confidential information using reasonable care and will not disclose it except to employees and contractors with a need to know who are bound by similar obligations. Customer data is confidential information of the customer. The Service and its non-public features are confidential information of PermitStack.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free. Regulatory content provided through the Service is for operational tracking and reference only; it is not legal advice and does not replace the judgment of a qualified compliance professional or the authoritative requirements of the issuing agency.
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Our total liability for any claim arising out of or relating to these terms or the Service will not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless 25 Fathoms LLC, its officers, employees, and contractors from any claim or demand arising from your violation of these terms, your violation of any law, or your infringement of any third party’s rights through your use of the Service.
Either party may terminate for material breach with 30 days written notice and an opportunity to cure. We may suspend the Service immediately for non-payment, security risk, or violation of the Acceptable Use section. Upon termination, your access to the Service ends, your data is exported on request and then deleted per the Customer Data section, and prepaid fees for the remainder of the term are non-refundable.
We may modify these terms from time to time. Material changes will be posted on this page with an updated revision date and, where the change affects an active customer, communicated by email at least 30 days in advance. Continued use of the Service after the effective date of a change constitutes acceptance.
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Hamilton County, Ohio, for any dispute the parties cannot resolve informally.
